A 21-year-old man suspected of being the driver in a fatal hit-and-run car accident that took place on July 20 has recently been arrested and will likely face a wrongful death lawsuit, in addition to the criminal case that is currently pending. According to the police report and court documents associated with this case, the suspect – Derrick Fransua – had allegedly been racing his PT Cruiser with another vehicle in the vicinity of the intersection of South Kipling Street and West Asbury Avenue. As this illegal vehicle race allegedly progressed, law enforcement officials believe that Fransua ran a red light, at which time he ran into and killed the 16-year-old victim who had been jogging at the time. The victim sustained severe injuries and was ultimately pronounced dead at the scene, and Fransua allegedly sped away from the scene of the accident.
Currently, Fransua is facing a series of severe criminal charges, including:
- Leaving the scene of a fatal accident
- Vehicular homicide
- Reckless driving
- Tampering with physical evidence
- Engaging in a speeding contest
- False reporting to authorities.
While the criminal case will proceed independent of a wrongful death lawsuit, should the victim’s family choose to pursue such a civil case against Fransua, the outcome of the criminal case – as well as any evidence that prosecutors use in it – could be crucial to helping the family secure a wrongful death settlement for the tragic loss of their loved one.
