Family law is a broad term including divorce, separation, annulment, paternity, parenting rights/responsibilities, parenting time (custody and visitation), maintenance (alimony), child support, post-decree matters (such as modification or enforcement of parenting rights, maintenance, child support, contempt proceedings, etc.). Mike Hulen and Ben Leutwyler, divorce lawyers, offer a free initial consultation so that you may quickly have your most pressing questions answered. Mike Hulen and Ben Leutwyler, who practice in Denver, Jefferson County and all other counties in the greater Denver metro area, will also discuss attorney fees and costs and give you a written fee contract. In family law cases, our goals are to protect the children, obtain a fair division of property and provide our client with an equitable resolution of all other financial issues. We work with our client to try and reach a prompt settlement of all issues. Both husband and wife will save a substantial amount of money that otherwise would be spent for attorney fees and litigation costs by pursuing prompt and reasonable settlement. The vast majority of divorce cases are settled without the need for a Permanent Orders (final) hearing before the Judge. Hulen & Leutwyler offers substantial experience in negotiating prompt and equitable settlements. However, we are prepared to represent you in Court, if that becomes necessary. If the parties have difficulty agreeing on certain issues, the process of mediation may offer substantial assistance. Most Courts require the parties pursue mediation before the Court will set the matter for a Permanent Orders (final) hearing. The mediator is selected by agreement of the parties. The mediator is an experienced family law attorney who doesn't offer legal advice or take sides; rather, the mediator hears the positions of both parties, then offers suggestions as to a fair resolution based on how the Courts have been ruling on similar issues, in recent cases. Mediation is usually successful and results in substantial savings of attorney's fees and litigation costs. (Mike Hulen is an experienced family law mediator). If mediation is unsuccessful, the parties must proceed to a final "Permanent Orders" hearing before a Judge (no jury). There are substantial additional attorney's fees and costs involved in preparing for and conducting the trial of a Permanent Orders hearing. Both parties should factor this in when determining whether the Permanent Orders hearing is absolutely necessary. If one party has a substantially greater income than the other, the Court may order that party to pay some of the attorney's fees and costs for the other. Mike Hulen is a very experienced divorce lawyer and has ably and professionally represented clients in hundreds of family law hearings. Ben Leutwyler is a very experienced trial lawyer and a very able divorce lawyer. If any aspect of your family law case must proceed to a Permanent Orders hearing, our divorce lawyers will attempt to reasonably settle as many of the issues as possible, thus minimizing the issues which must be presented in Court and determined by the Judge. This will result in a substantial savings in attorney's fees and litigation costs, compared to having to try each and every issue in the case. Custody and visitation - now called parenting plan and parenting time - are frequently the most emotion laden and most difficult to resolve issues. Mike Hulen has previously served as a Judge*, presiding over divorce and custody cases, and has represented hundreds of fathers and mothers when children's issues were involved. He has also been appointed to represent the best interests of the child or children in "custody" cases**.
