During the afternoon on Wednesday, November 14, 2012, a motorcyclist was hospitalized due to serious injuries he had sustained as a result of running into a car that made a left-hand turn directly in front of him. The female driver of the car, a General Motors Pontiac, and her baby riding in the car had only suffered minor injuries; however, the motorcyclist who had slammed into the car because he did not have time to stop is now fighting for his life in an intensive care unit.
While police detectives are still investigating the motorcycle and car accident, they have not announced whether any criminal charges will be filed against the driver of the car. Should it be determined that the driver had been intoxicated or somehow breaking the law, criminal charges, such as DUI or vehicular assault, may be filed against the driver, whose identity has been kept confidential thus far; if, however, criminal charges are not filed against the driver, but the driver was found to be somehow negligent or reckless in her behavior that led to the accident, the injured cyclist can file a civil personal injury lawsuit against the driver in an effort to secure compensation for his injuries or permanent disabilities, medical bills, lost wages and mental anguish.
Some of the factors that may have played a role in causing the accident could possibly include driver distraction (i.e., talking or texting on a cell phone), driver inexperience and/or poor signage or lack of signals on the roadways to adequately alert motorists of oncoming traffic.
